Procter & Gamble Comp. v. Randy L. Haugen II
The 10th Circuit reversed lower court's dismissal of the case on several grounds and concluding the district court abused its discretion by failing to address any of the factors outlined in Whrenhaus v. Reynolds, 965 F.2d 916 (10th Cir. 1992). There was no evidence that P&G acted willfully, in bad faith, or with culpability. It was unclear how P&G was to produce the data because each available option was problematic.
