United Medical Supply v. United States
A contractor sought discovery of government records indicating whether the United States had bought medical
supplies for military hospitals and clinics in Oklahoma and Texas under terms that violated the agreement with
the contractor. The government failed to properly notify certain medical facilities to preserve documents and
failed to follow up with the hospitals to ensure preservation efforts under way.
AAB Joint Venture v. United States
In a contract action, plaintiff asserted that the government had produced limited email for only six of 27
individuals identified by the government and known to have generated email related to plaintiff's contract.
The court held that the government's duty to produce documents was not affected by preserving evidence on backup
tapes and thereby making it more expensive to produce.
